ASTRO SHUANG XING WEBSITE CONTEST STANDARD TERMS & CONDITIONS

1. General   a. The Astro Shuang Xing General Contest Terms and Conditions (“Contest Terms & Conditions”) shall apply to all Contestants (hereinafter defined) who enter any contest (“Contest”) organised by Astro on the Shuang Xing Website. b. The Contest is open to all registered e-pass members on www.astro.com.my who are members of the Shuang Xing Website (“Contestants”). Contestants must be above 18 years old. c. By entering into any Contest, the Contestants shall be deemed to have accepted these Contest Terms & Conditions. d. Contestants must submit the Contest entry via Astro's website at www.astro.com.my 2. Charges   a. Contestant’s shall bear their own Internet Service Provider (ISP) charges, whichever applicable, and all other related costs in submitting the Contest entries to Astro. 3. Contest Entries   a. The Contestant must ensure that their Contest entry is complete and accurate. Incomplete, illegible or late entries shall be disqualified. b. Astro reserves the right to reject any registration (where applicable) and/or entry at its sole and absolute discretion without having to assign any reasons whatsoever. c. Where applicable, all Contest entries must be submitted in the language specified. Contest entries in any other languages will be rejected by Astro. d. Employees of ASTRO ALL ASIA NETWORKS plc (“Astro”) including its subsidiaries and affiliates, sponsors, agencies, dealers, retailers and their immediate family members are not eligible to participate in this Contest. e. Contestants under the age of 18 are not eligible to enter the Contest unless otherwise stated. Where indicated otherwise, Contestants under the age of eighteen (18) must seek parental and/or guardian approval before participating in the Contest. Astro considers it the responsibility of parents and/or guardian to monitor their children’s participation in this Contest. 4. Judging   a. The Judge’s decision is final and binding. No correspondence shall be entertained. 5. Notification of Contest Winners   a. Contest winners will be notified in the manner that is indicated above. Notwithstanding the foregoing, Astro reserves the right to use any other method or medium Astro deems fit at its sole and absolute discretion for the purpose of announcing the Contest winners. b. Upon request, Contest winners will be required to give their contact details, I.C. No., Astro account number and any other details deemed necessary and relevant by Astro at its discretion within the time period specified or upon receiving the request/notification from Astro. c. Proof of mailing, faxing, or delivering (in any manner whatsoever) any details to Astro does not denote proof that Astro has received such details d. Astro reserves the right to appoint a third party to conduct the verification of Contest winners and to fulfil the delivery of prizes and Contestants agree that Astro may provide all necessary information of Contest winners to such third party to facilitate such service.     6. Contest Prizes   a. Astro reserves the right to change the prizes without any prior notification. b. The Contest winner shall be responsible for all costs in connection with perfecting his/her prize, including but not limited to legal cost, stamp duties, registration and transfer fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses, upgrades etc.) or fees. c. Each Contest winner shall be entitled to one (1) prize only. d. Prizes not claimed within the time period specified or upon request/notification from Astro shall be forfeited. Prizes are not exchangeable, transferable or redeemable in any other form for whatever reason. Contest winners are solely responsible for the collection of their prize and Astro and its agents, sponsors and representatives shall have no liability to the Contest winners in any respect whatsoever. e. Prizes are non-transferable and there is no cash alternative. f. Astro reserves the right to request written proof of residency and of the age of any Contest winner before the prize is dispatched or collected. g. Prizes must be claimed in person unless Astro advises otherwise. Identification which includes a photograph will be required (examples include identification card/drivers licence/passport which displays a photograph of the Contest winner). Where Astro elects to post a prize to a Contest winner no responsibility will be accepted by Astro for the safe and effective postal delivery of the prize. h. In special situations, and subject to the absolute discretion of Astro, a Contest winner may nominate a designated representative to collect a prize. The representative will be required to present written authorisation from the Contest winner and identification which includes a photograph for both the Contest winner and their representative. i. In the event that a Contest winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of Astro. j. The Contest winner(s) of any prize(s) may at the absolute discretion of Astro be required to execute a deed of release and indemnity in a form prescribed by Astro in order to receive the prize. k. All prizes are accepted entirely at the risk of the Contest winner, and Astro makes no warranties or representations whatsoever and excludes all warranties in connection with any prize to the extent permitted by law and shall not be responsible nor liable for any problems and/or damage thereto or arising therefrom. Contest winners shall comply with any additional terms and conditions of each prize, where applicable. l. Where applicable, cash prizes shall be issued to the winners in the form of a cheque. Cash prize winners will be responsible for all related banking charges (including outstation cheque charges) imposed by banks in clearing his/her cheque. m. Where the prize is in the from of tickets to a particular show, movie or event, the Contest winner shall be bound by the event promoter’s terms and conditions together with those set out on the ticket and the rules and regulations of the venue. n. Travel Prizes (where applicable) i. Unless otherwise specified, the class of travel for any travel prize incorporating an airfare is economy class. ii. Travel prizes must be taken within the time period in accordance with the dates and destinations and number of passengers specified by Astro, its agencies, sponsors and representatives or will be deemed invalid. There will be no cash alternative. There will be no alternative destination. iii. Travel prizes are non-transferable and are subject to availability. Travel prize winner must hold a valid passport with at least six (6) months' further duration (or competition entry will be invalid). iv. Any travel by minors shall be in accordance with the terms and conditions of the respective carrier and where specified accompanied by the parent(s) or legal guardian. v. In the event of unforeseen circumstances or circumstances outside Astro's reasonable control Astro reserves the right to offer an alternative prize of equal value. No cash will be offered. vi. Travel prize winner shall comply with the terms and limitations of any insurance policy relating to the travel prize. vii. Travel prize winner shall comply with the terms and conditions of the airline and other transportation and venues involved in the Contest or the travel prize. In particular, the travel prize winner shall comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements and are responsible for attending to any inoculation and health regulations required for their destination. viii. Travel prize winners are not entitled nor authorised in any way to commit Astro, its agencies, sponsors and representatives to any contract, expense or cost entered into or incurred. No variation of these Contest Terms and Conditions is effective unless approved by an authorised representative of Astro in writing ix. It shall be the responsibility of winners to obtain the necessary visa and other travel documents at their sole cost and expense. Passport control and in-country authorities will reserve the right to refuse entry. If the winner of a travel prize is refused passage and or entry/exit to or from the country being visited, any additional costs incurred will be at the sole cost and responsibility of the travel prize winner and no compensation whatsoever will be given should the travel prize winner, regardless of the circumstances. x. Any flights, other transport, airport details, accommodation or other aspects of the travel prize, dates and times quoted by Astro, its agencies, sponsors or representatives are for guidance only and are subject to change without notice with no liability arising against Astro, its agencies, sponsors or representative. xi. Travel prize winner must have sufficient financial resources to meet any financial commitment which they may incur in connection with the travel prize beyond those included in the travel prize itself (including, without limitation, transfers to and from any airport specified in the travel prize, meals and drinks, room services, laundry, excess baggage, personal, medical and/or baggage insurance, all items of personal nature, custom tax and airport tax.). o. Where the prize is in the from of tickets to a particular show, movie or event, the Contest winner shall be bound by the event promoter’s terms and conditions together with those set out on the ticket and the rules and regulations of the venue. 7. Proof of Receipt   a. Proof of Contest entry sent by a Contestant does not denote proof that the Contest entry was received by Astro. 8. Prize Giving Ceremony   a. In the event Astro has a prize giving ceremony, the Contest winner(s) are required to attend at his/her own cost and expense to collect the prize. In the event the Contest winner is not able to attend the prize giving ceremony, the Contest winner must nominate a representative to be present at the prize giving ceremony to accept the prize on his/her behalf. 9. Intellectual Property Rights and Publicity   a. Where Contestants are required to submit any photographs, drawings, pictures, slogans, or any other creative work, including the nicknames, names, voice or video recordings (“Intellectual Property”) with the Contest entry, the Contestant shall warrant that all Intellectual Property Rights in such submission shall be the property of Astro. b. Astro reserves the right, at its sole and absolute discretion, to use and exploit the Intellectual Property in any manner that it deems fit without first obtaining any consent nor making any payment whatsoever to the Contestant and/or the Contest winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media 10. Promotional Activites   a. Astro and/or its affiliates reserve the right to send SMS messages or email notification to the Contestants mobile phone numbers or email address containing information and promotional activities regarding any other Astro promotions. b. If a Contestant does not wish to receive such SMS messages or email the Contestant is required to call and inform Astro accordingly by calling Astro’s call centre at 1300-82-3838. 11. Adherence to Contest Terms & Conditions   a. All Contestants shall be required to adhere to the Contest Terms and Conditions and the Astro Website Terms of Use and Notices including any changes made thereto. Astro reserves the right to forfeit the prize(s) in the event any of the Contest Terms and Conditions and/or the Astro Website Terms of Use and Notices are not adhered to. 12. Variation to the Terms & Conditions   a. Astro reserves the right to change, amend, delete or add to these Contest Terms and Conditions without prior notice at any time and the Contestants shall be bound to such changes. b. Astro may at its sole and absolute discretion extend the Contest Period at any time without giving any prior notice. Your participation in the Contest during the extended period shall be governed by this Terms and Conditions. c. The main language of the Contest Terms and Conditions shall be the English language. Any translation to any other language other than English shall be for convenience only. In the event of any inconsistency between the English language version and that of any other languages, the English language version shall prevail and govern in all respects. 13. Liability   a. Astro will not be responsible or liable for: i. any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending a Contest entry as a result of any network, communication, Internet Service Provider (ISP) or system error, interruption and/or failure experienced by the Contestant’s telecommunication service provider and/or by Astro and/or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption and/or failure, Astro shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time. ii. any problem, damage or loss of whatsoever nature to any Contestant, or their authorised representatives resulting from their participation in the Contest iii. any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control. 14. Disqualification   a. Astro reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or the operation of the Contest, to be acting in breach or potential breach of these Contest Terms and Conditions and/or the Astro Website Terms of Use and Notices. No correspondence shall be entertained. 15. Suspension   a. Astro further reserves the right to cancel, modify, suspend or delay the Contest for any reason whatsoever. 16 Governing Law   a. The Contest Terms and Conditions shall be construed, governed and interpreted in accordance with the laws of Malaysia.
